SCOPE

The Orange Bowl Committee, Inc., a Florida nonprofit and 501(c)(3) corporation (the “OBC,” “we” or “us”), is making available to its members (and only its members and staff) a membership app on its website (the “Membership App”) to provide a searchable, customized membership data base and to allow member-to-member communications and event management.

This Privacy Policy (“Policy”) describes how the OBC treats personal information we collect about you through our websites and platforms where the Policy is located (the “Platform”).  This Platform is operated in the United States and intended for use solely by individuals who are members of the OBC and located in the United States. By using our Platform or by choosing to give us personal information, you signify your consent to this Privacy Policy and the related Terms of Use. If you do not agree with any terms of this Privacy Policy or the Terms of Use, please do not use the Membership App or the Platform and do not give us any personal information. TYPES OF PERSONAL INFORMATION WE COLLECT
The OBC collects personal information from you and about you. Here are some examples of the personal information we may collect:

  • Identifying Information. For example, you may provide your name, business or personal address, unique personal identifiers, online identifiers, telephone number, and email address. You may also provide your mobile phone number.  You may edit your personal information or request that the OBC do so by contacting the Vice President of Membership Services & Community Engagement.
  • Account Information. If you create an account on our Platform, we may collect your account log-in and password.
  • Social Media Information. We may collect personal information you post on our social media pages. We may also collect your social media profile information and personal information posted on your page.
  • Billing Information.  In the event that, at a later point the OBC decides to provide a link to its service provider (such as Ticketmaster) for ticket sales to OBC events, this may include your billing address and your preferred method of payment.
  • Information You Post or Submit. We may collect personal information you post in a public space on our Platform. We may collect personal information that you submit when you contact our customer service team or your account representative. We may also collect information when you complete any survey that may be distributed for users to make suggestions on the Platform and Membership App.
  • Demographic Information. We may collect demographic information such as your birthdate, age, and zip/postal code. We may also collect your race and gender.
  • Device Information. For example, we may collect the type of device you use to access our Platform. We may also collect your browser information, device identifier, IP address, or operating system type.
  • Location Information. For example, we may collect information about the city or state where you are located. We may also collect geographic information based on your IP address.
  • Usage Information. For example, we may collect information about how you use our products or services. This includes collecting information about your interactions with the Platform.
  • personal information from time-to-time or contact the OBC’s Vice President of Membership Services & Community Engagement to have us edit such information.  The OBC’s Vice President of membership Services & Community Engagement may also update your information to reflect any Board or officer elections or committee assignments.

HOW WE COLLECT YOUR PERSONAL INFORMATION
The OBC collects your personal information in different ways. Below are some examples of how we may collect your personal information.

  • Directly From You. For example, when you:
    • Register for an account.
    • Request information from us.
    • Sign up to receive promotional communications or a newsletter.
    • Complete a survey.
    • Make a purchase through our Platform in the event at a later point we provide links to third-party providers such as Ticketmaster or Hard Rock Stadium.
    • Submit information to or through our Platform.
    • Submit a request to, or engage with, our customer service team.
    • Interact with our social media pages.
    • Otherwise interact with us.
  • Passively. For example, when you:
    • Visit and navigate our Platform on any device.
    • Enable location-based features on our Platform.

We may also collect personal information about users over time and across different websites and devices when you use the Platform.

  • Combining Information. For example, we may:
    • Combine personal information that we collect offline with personal information we collect through our Platform.
    • Combine personal information we collect about you from the different devices you use to access our Platform.
    • Combine personal information we get from third parties with information we already have about you.

HOW WE USE YOUR PERSONAL INFORMATION
Examples of how we may use your personal information include:

  • To Provide easy access to general contact and other information on the OBC’s general membership as well as Board of Directors, Members and Committee meetings. These would include locations, dates and time as well as cancellations.
  • To Improve Our Platform and Services. We may use your personal information to make our Platform and services better. We may also use your personal information to customize your experience with us.
  • To Understand Your Interests. For example, we may use your personal information to better understand what interests you.
  • To Respond to Your Requests or Questions. This may include responding to your requests and questions.
  • To Communicate with You. We may communicate with you about your account or our relationship. We may also contact you about this Policy or our Platform terms and conditions.
  • To Determine Your Eligibility. We may use your personal information to verify your identity or determine your eligibility to participate on the Platform, such as ensuring that you are a resident of the United States and otherwise a member of the OBC. For example, this may include verifying your age, date of birth, and state of residence.
  • For Marketing Purposes. We may provide you with information about new events and special offers. We might tell you about new features or updates. These might be third-party offers or products we think you might find interesting. We may also use your personal information to send you electronic communications, including through email or text message.
  • For Security Purposes. This could include protecting our company and its members. It may also include protecting our Platform or investigating a potential fraud.
  • As Otherwise Permitted or Required by Law or As We May Notify You. This includes using your information for our legitimate business needs.
  • As Requested or Directed by You.

HOW WE SHARE YOUR PERSONAL INFORMATION
We may share your personal information in the following ways:

  • Internally. We may share your personal information with our affiliates and subsidiaries for the purposes described in this Policy.
  • On Our Platform. For example, we may publicly display personal information you post on our Platform.
  • With Our Service Providers. We may in the future determine to provide links to third-party providers, such as Ticketmaster or Hard Rock Stadium, in order to allow you easy access to event tickets, etc.  In the event that you use the Ticketmaster or other third-party vendor or provider, you will be subject to their Privacy Policies and Terms of Use.  These third parties may also share your personal information with others. These third parties may use your personal information for their own marketing purposes or the marketing purposes of others. This may include the delivery of interest-based advertising.  In the event that you use the Ticketmaster or other third-party vendor or provider, you will be subject to their Privacy Policies and Terms of Use.  Please note that this Policy does not apply to personal information collected directly by such third-party vendors or providers. If you have questions about the privacy practices of those organizations, please contact them directly.
  • To Comply with the Law or to Protect Ourselves. For example, this could include responding to a court order or subpoena. It could also include sharing personal information if a government agency or investigatory body requests. We might share personal information when we are investigating a potential fraud.
  • As Requested or Directed by You. This may include instances where you ask us to share your personal information with a third party.
  • For Other Reasons We May Describe to You at the Time of Collection.

PROVISIONS APPLICABLE TO RESIDENTS OF CERTAIN STATES OR TERRITORIES

CALIFORNIA PRIVACY NOTICE
The California Consumer Privacy Act (“CCPA”) is not applicable to the OBC as a nonprofit 501(c)(3) corporation which is not organized or operated for profit nor is it “doing business” within the State of California.

NEVADA PRIVACY NOTICE
If you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A (“603A”), you have the right to submit a verified request to us, directing us not to make any sale of certain “personal information” as defined under this law that we have collected or will collect about you.  Nevada residents who wish to exercise their rights under this section can contact us by email at  privacy@orangebowl.org, Please indicate you are a Nevada resident making a “Nevada Opt-Out” request and identify the OBC and its affiliates to which your request relates.

Residents of Other States.  If you are not a resident of California or Nevada, you may still be able to assert a legal right regarding our collection and use of your information under applicable federal and state law. Under these applicable laws, you may have a number of rights, including:

  • The right not to provide your personal information to us;
  • The right to object, stop, or limit the processing of your personal information;
  • The right to request the erasure or restriction of processing of your personal information in our possession;
  • The right to have your information transferred to another data controller;
  • The right to withdraw your consent;
  • The right to access to your information and request from us a description, or a copy, of the types of personal information we have stored about you; and
  • The right to request update or rectification of your personal information.

Canadian Resident Rights – Accessing and Correcting Your Information If you are a resident of Canada, you have a right to request access to your personal information and to request a correction to it if you believe it is inaccurate. If you would like to have access to the personal information we have about you, or if you would like to have it corrected, please contact us using the contact information provided below. In some cases, we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. To help protect against fraudulent requests for access to your personal information, we may ask you for information to allow us to confirm that the person making the request is you or is authorized to access your information before granting access. For example, we may require you to verify your identity before you access your personal information.

CHILDREN UNDER 18
The Platform where this Policy is located is meant for adults. We do not knowingly collect personally identifiable data from persons under the age of 18 years and strive to comply with the provisions of COPPA (the Children’s Online Privacy Protection Act).  If you are a parent or legal guardian and think your child under 18 years of age has provided us with personal information, please contact us at   privacy@orangebowl.org.  You can also write to us at the address listed at the end of this Policy. SECURITY
The Internet is not 100% secure. We cannot promise that your use of our Platform will be completely safe. We encourage you to use caution when using the Internet. We use physical, technical, and organizational means to help safeguard personal information under our control.  A username and password are needed to access certain areas of the Platform. It is your responsibility to protect your username and password. Personal Information may be accessed by persons within our organization, or our third-party service providers, who require such access to carry out the purposes described in this Policy, or otherwise permitted or required by applicable law.  Personal Information we collect is managed from our offices in the State of Florida.

STORAGE OF PERSONAL INFORMATION
Personal Information we maintain may be stored in or outside of the United States. If you live outside of the United States, you understand and agree that we may transfer your personal information to the United States. This Platform is intended for use solely in the United States and is subject to the laws of the United States, which may not provide the same level of protections as those in your own country. Personal Information processed and stored in another country, including the United States, may be subject to disclosure or access requests by the governments, courts or law enforcement, or regulatory agencies in that country according to its laws. By using our Platform or by providing us with personal information, you consent to any such transfer of information outside of your country.

LINKS
Our Platform may in the future contain links to other third-party sites (such as Ticketmaster) that are not governed by this Policy. This includes third-party sites that offer resources and content which you can access through our Platform. If you click on a link to a third-party site, you will be taken to a site we do not control.  We are not responsible for the privacy practices used by third-party sites. We suggest that you read the privacy policies of those sites carefully.

From time to time, we may change this Privacy Policy. We will notify you of any material changes to this Policy as required by law. We will also post an updated copy on our Platform. Please check our Platform periodically for updates. Your continued access to and/or use of our Platform after any such changes constitutes your acceptance of and agreement to this Privacy Policy, as revised.
